HB 2165 expands the crime of unlawfully hosting minors consuming alcoholic liquor or cereal malt beverage to include recklessly permitting a person’s land, building, structure or room owned, occupied or procured by such person to be used in such a manner that the results in the possession or consumption of alcoholic liquor or cereal malt beverage by a minor.
The penalty is a class A misdemeanor, with a minimum fine of $1,000. If the court sentences the offender to perform community service work as a condition of probation, the court is required to consider ordering the offender to serve community service at an alcohol treatment facility.
The bill provides that no civil liability is created for any lodging establishment.
So those of you planning on hosting a “kegger” for your kid when they graduate from high school, I would caution you to think again and then do not do it. I would suspect our law enforcement would be on this as it relates to public safety and saving lives.
House Sub. For SB 145 requires vehicles to be driven in the right lane on a multi-lane road outside of a city, increases certain permit fees charged by KDOT, and changes requirements for cotton module permits.
Specifically the bill amends existing law to require vehicles to be driven in the right lane when two lanes of traffic are going in the same direction on a highway outside of any city. It also requires vehicles on highways with three or more lanes preceding in the same direction not to be driven in the far left lane.
Exceptions: when overtaking and passing another vehicle; when preparing to make a proper left turn; as otherwise directed by official traffic-control devices; or as otherwise required by other provisions of law. We are still working on the violation of driving for extended distances oblivious that your turn signal is on.
The provisions do not apply to authorized emergency, law enforcement, or KTA vehicles used for construction or maintenance work. Law enforcement officials will be required to issue warning citations for the first full year following the effective date of the bill. (July 1, 2010).
It restricts to 50,000 pounds the gross weight on tandem axels of a cotton module issued a special permit for an oversize or overweight vehicle on a highway under KDOT’ s jurisdiction. The bill excludes such a cotton module from being considered a superload. We all should be happy about this legislation.
I received comments and requests for help from many you this past week. If I have not responded yet please be patient but if you have not heard from me in a couple of weeks give me a call. I heard from many that they do not agree with many of the legislative or agency policy statements coming from Topeka. I appreciate your criticism, but please offer your suggestions on how you would prefer to proceed.
I am accepting applications for an intern during the upcoming session (Jan-Mid May). As a legislator my role is to provide a strong learning environment for the intern and in addition to the training, interns will assist with my legislative duties. The intern will accompany me throughout the day by attending caucus and committee meetings, attending session, meeting with constituents, colleagues and agency personnel.
The interns will not be used for personal, campaign or secretarial duties. The real benefit comes from participating in the process, interacting with government officials, other interns, and legislators. It is recommended the intern be available for 16 hours a week (12 days). We can work out a schedule that does not interfere with their normal studies.
All intern applications are due by Friday, December 4, 2009. Interns are required to attend orientation on Thursday, January 7, 2010 where they receive an orientation, tour the capitol and hold a question and answer period. Completion of the orientation is mandatory to be eligible for all the benefits of the internship program (parking, mileage reimbursement, academic credit, etc.). Intern information has already been sent to all Kansas Secondary education institutions.
