POSITION STATEMENT ON DR. TILLER LITIGATION

By request of numerous constituents, I have been asked to investigate the possibility of initiating legislative action to require the Attorney General to proceed with prosecuting Dr. Tiller, Wichita Kansas Abortionist.

As a PRO LIFE legislator, I am totally opposed to the practice of performing abortions on demand or as a method of birth control. The allegations of mis-conduct and failing to report crimes that have been directed at Dr. Tiller do cause me great concern.

K.S.A. 75-702 in part states "The Attorney General shall appear for the state, and prosecute and defend all actions and proceedings..... when required by the governor or either branch of the legislature...." The statute does provide for a way to get into court certain actions. In thinking about using this provision in Dr. Tiller’s case, many factors must be considered.

Unfortunately in this state the current governor and attorney general are both PRO-ABORTION and I am concerned that any action we direct might be pursued in a manner that would do more harm than good. One real concern is the possibility of creating a bad precedent for pro-lifers at the appellate court level.

The attorney general has already dismissed the case that was filed by the previous attorney general and there are serious reasons to be concerned about banking on him as the way to go after Tiller now. Please know that we are looking into various options regarding Dr. Tiller, but we need to make sure we select an option that will achieve our shared goal of bringing him to justice.
